The Registration of Adoption Act is the only mechanism that can be utilized by Muslims to ensure that their adopted child is legally recognized. The question here is whether or not this Act can cater to the special needs of the Islamic adoption rules? This study tries to answer this question and identify the Muslims needs for specific written rules regarding Islamic adoption procedures. Analysis is done on the Registration of Adoption Act and various enactments on Islamic Family Laws that are being applied in each state. It is found that the said Act and enactments are not sufficient to proffer these needs.

In , Malaysia adopted a major piece of legislation relating to children, the Malaysia Children Act. While a section of the Act is dedicated to children in need of care and protection, there is no provision for affording such children an opportunity to be heard either directly or through a representative.
The Court must consider a report by the Protector or Social Welfare Officer including information on the family background, general conduct, home surroundings, school records and medical history of the child.
